Terms for using Pain Monkey
These terms are between you and Evan Herbstman, an individual in New York, United States, operating Pain Monkey. Contact evherbstman@gmail.com about the service or these terms. Requesting an account or submitting research indicates your agreement to these terms. The beta is for people aged 18 or older. If acting for an organization, you must have authority to agree for it.
What the free beta provides
Pain Monkey helps you research app ideas using public web sources and plan customer tests. The beta offers one research report per account while shared capacity is available. There is no payment, subscription or automatic renewal in this release. Any future paid offer will show its price, deliverable, billing and cancellation/refund terms before purchase.
AI research has limits
Reports are AI-assisted and may contain incomplete, outdated, irrelevant, misleading or incorrectly interpreted information. Independently check factual claims against the original sources before using or sharing them. A source citation is a lead to inspect, not a guarantee that a claim is accurate. Examples are illustrative and are not customer testimonials.
A report, score or proposed test does not guarantee demand, profitability, market size or startup success. Proposed audiences and tests are hypotheses. This is general research assistance, not legal, financial, investment, medical or other professional advice. You remain responsible for your business decisions and for obtaining permission and following applicable rules when contacting potential customers.
Allowance, interruptions and availability
A report reserves its allowance when research starts. Completed steps are saved. Keep the tab open to continue research; an uncertain or failed provider request is not automatically repeated. An incomplete report can use the allowance. Contact support if it fails; another report is not guaranteed. Deleting a report or account does not restore allowances.
Availability and limits may change during the beta. We may suspend abusive activity or access that creates a security or legal risk. The beta may be changed or discontinued. When practical, we will give notice before planned discontinuation so you can download your work; urgent security or legal action may require immediate restriction.
Your account and submissions
Keep your email account and sign-in access secure. Only submit information you have permission to provide to us and our service providers. Do not upload confidential material, credentials, sensitive personal records, children’s data or private information about other people. Describe customer groups without identifying individuals.
Do not bypass access controls or allowances, obtain someone else’s reports, send abusive automated requests, infringe intellectual property rights, or use the service for unlawful surveillance, harassment or decisions about a person’s employment, credit, housing or other legal rights. Follow the rules of any third-party services you use.
Ideas, reports and source material
You retain the rights you hold in your submissions. You permit us and our service providers to process, store and transmit them as needed to deliver, secure and support the requested service, as described in the privacy policy. This permission does not authorize us to sell your idea or publish a private report as a testimonial.
You may use and download your report for your research and planning, subject to applicable law and third-party rights. AI output may be similar to other people’s output and may not qualify for exclusive intellectual property protection. We do not grant ownership of third-party articles, comments, trademarks or other source material. Keep attribution and source links when sharing passages; do not republish material beyond what your permission or applicable law allows. A citation alone does not grant a license.
Privacy, downloads and complaints
Read the privacy policy before providing information. Reports can be downloaded or deleted in your workspace. Local planner files, update subscriptions and support messages have separate handling described there.
Report privacy, security, copyright or inaccurate-source concerns to evherbstman@gmail.com. Include the report ID or affected URL, a description and a way to contact you. Do not send credentials or unnecessary personal information. We will investigate and may restrict or remove disputed material while reviewing it.
Responsibility and applicable rights
To the extent permitted by applicable law, the experimental beta is provided as available, without a promise of uninterrupted operation or fitness for a particular business outcome. Nothing in these terms excludes obligations or liability that cannot lawfully be excluded, including applicable mandatory consumer rights. These terms do not require arbitration or waive class actions.
New York law governs these terms to the extent permitted by applicable law, without removing mandatory protections or court rights you have where you live. Please contact us first if something goes wrong so we can try to resolve it.
Changes to these terms
We will update the effective date and provide notice of material changes in the app or by email as appropriate. Where required, we will request renewed agreement. New paid terms or a change of operator will be disclosed before they apply to you.
